Washington Superior Court (Walla Walla County)
Records, 1859-1914

The records of the Superior Court for Walla Walla County (78-16) were received by the Washington State University Libraries in 1938 along with the Walla Walla Fire Insurance Company records. They were separated by Lawrence Stark in 1973 and were arranged and described by Richard D. Scheuerman in October, 1979. Further documents were discovered in a file cabinet at WSU Libraries in 1997 and added to this collection as folder number 79 at that time.

ORGANIZATIONAL HISTORY

The Organic Act for Washington Territory, passed by Congress in 1853, stipulated that the court system in the territory would consist of a Supreme Court, district courts, probate courts and courts of justices of the peace. The Territorial Legislature then divided the territory into three judicial districts, the first being Walla Walla. It was the responsibility of this district court to try all criminal cases except petty ones and all civil suits in which over $100 was claimed except for probate cases. This judicial arrangement continued until 1889 at which time Washington became a state and Congress established a new system of federal district and circuit courts and Walla Walla came under the juristiction of a state superior court.

DESCRIPTION AND ARRANGEMENT

The records of the District and Superior Court at Walla Walla contain transcripts of case testimonies, summaries of court decisions, returned summons, citizenship applications, deeds and various county records associated with the court. The material dates from 1859 to 1909 and is arranged into two series. The files for 1859 are copies of the originals made in 1882.

Series One consists of court decisions, affidavits and other legal records which are arranged chronologically. Within each year the files are alphabetized by the plaintiff's last name. The majority of cases involve civil disputes such as divorce settlements and debt claims. Most of the criminal cases relate to the illegal selling of liquor to Indians. Undated case files conclude Series One.

Series Two consists of two ledger books: District Court Costs, 1862-1866, and the County Clerk's Minutes Book for 1879.
